This Influencer Agreement will govern your participation in The Beauty Influencer Bag Program ™ at Stewart Boutique.

This Influencer Agreement is between you (“you”) and Stewart Magic Hair™ , which is a business organized and existing under the laws of Ohio, United States of America (“Stewart Magic Hair™ ”). 

If you have registered for or on behalf of an entity you are deemed to have accepted this Agreement on behalf of that entity.

Details

In consideration of the mutual covenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties, intending to be legally bound, agree as follows:

1. Create Original Content. Once you receive the hair, you agree to create genuine, permanent original content using the item in a tastefully arranged photograph, set of photographs or video.
2. Social Media Platforms. You are required to, at minimum, post to the platform from the list below in which you have the largest following at minimum, a weekly basis. Follow the different requirements applied to each specific platform:
   1. Instagram. If you are posting on Instagram, Stewart Magic Hair™  requires a photo/reel or video that prominently features the item(s), styled as you wish, linking to @Stewart.Boutique, using the hashtag #StewartMagicHair #StewartBoutique #TheBeautyInfluencerBag™ , and including text similar to “find this ___________ at Stewart Boutique.  Call for Pricing. You can see the hair on me! It's luxury quality!” in the caption. Posting to your stories (is encouraged) is a great way to generate traffic, however, it is not considered a permanent post as described above and should not be the only post created.
   2. Facebook. If you are posting on Facebook, Stewart Magic Hair™ requires that you use one or more images of the hair and you, along with at least 1 full sentence about the hair and your experience with it in the caption. You are also required to include a link to our Facebook page (@StewartBoutique).
   3. YouTube/TikTok/Reels. Videos do not have to be exclusive, adding our items as part of a broad topic is acceptable and encouraged. Stewart Magic Hair™ requires a link in the description to our Instagram page (https://instagram.com/Stewart.Boutique).
3. Post Within Two (2) Weeks of Receipt. Your post must be made public within two weeks of your receipt of your item(s). You must complete your agreed-upon post and reporting within two weeks in order to remain on our list of affiliates and receive additional items for the following launch.
4. Communications. You will provide a form of communication in which you are accessible within a reasonable amount of time. The communication platform must be one that you check regularly and respond within a reasonable time frame.
5. Continuation of Program.  Stewart Magic Hair™ agrees to continue the Influencer Program as long as budget and business planning allows and will notify all Influencers and their teams of any change.  Stewart Magic Hair™ reserves the right to discontinue the program and/or remove members of the program at any time.
6. Continuation of Participation.Following this process is the best way to ensure your participation as a Influencer for the long haul. We reserve the right to discontinue your participation at any time if you do not follow the procedures.
7. Failure To Comply. If you fail to comply with this agreement after you have received any hair, we may request, at our discretion, to have the item shipped back to us at your expense. If the hair is damaged you agree to be liable for the total value of the item regardless of whether that damage was caused directly or indirectly.

Product Content

For any data, content, and images provided by you or accessed by  Stewart Magic Hair™ (directly or indirectly through your social media channels) in connection with the Influencer Program (collectively, “Product Content”), including photos, videos, and Product Listing content, you specifically give  Stewart Magic Hair™ the following permission: you grant  Stewart Magic Hair™/Stewart Boutique,  a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any Product Content in connection with the The Beauty Influencer Bag™ Program. You are to use content already approved and used on our social media pages, as its been branded, or permission given to use.  

Please do not use your own hair images. You can make your own flyers, cards, posters, etc.  If there's something you need to promote, but don't see it on our social media or website, please ask and we'll get it to you.

Prohibited Activities

Discrimination on the basis of race, ethnicity, gender, religion, sexual orientation, age or disability or any other unlawful basis under applicable law.

Team Building

We encourage you to boss up with other ladies and build a team! Your team members are under your supervision/direction and guidance and they must abide by our rules.  They are not an official member, and do not receive free hair.  They will be able to earn a commission on all sales and help build up your cumulative referral revenue.  Your sales commission is based on your/your team's cumulative referral revenueand qualifies you for Teirs and bonues.  

Rising Star: $0-$1000 commission is 5% for you and anyone on your team.
Star: $1000-$5000 is 10% commission for you and anyone on your team.

SuperStar: $7000 or more the commission is 15% for you and anyone on your team.

Commission payouts are paid to the Influencer, who is responsible for keeping track of their teams sales.  We suggest adding a different letter at the end of your Influencer number and give it to each member.  You only submit yours to us, and only have your clients submit yours to us as well.  We don't recognize your custom made Influencer numbers.  Commisson payouts must be invoiced by the 1st of each month and submitted to StewartBoutique.com@gmail.com and paid out via $CashApp by the 5th of the month for the previous months sales along with a commission report. 

Example: You have 3 people on your team and your Influencer 7 digit influencer number is 1271277. 

Team Member 1:  1271277A
Team Member 2:  1271277B

Team Member 3:  1271277C ...and so on

Customer/Team Ordering
You are going to want to have your team rocking Stewart Magic Hair™ so they are essentially your customers too!  They get a 10% discount on all orders.  Your followers get the same deal! So encourage people to call us to order hair and give your Influencer number.  

Oders are placed by calling 614-686-HAIR(4247).  Payment is due up front for ALL orders via Cashapp at @StewartBoutique. Bulk orders will be invoiced up front using Stripe, payable by credit card or bank account.  

We encourage you to purchase the bundle at our price and then sell it to the customer at your price.  You will make your normal commission on our price, plus your overage.

Wholesale/Bulk Hair
We offer bulk hair at wholesale prices.  If you know of a salon who needs hair, become their hair distributor, earn big, and increase your cumultive referral revenue. 

Customer Refunds/Returns

Due to COVID-19, its many variants, and Monkeypox, we are not accepting returns at this time.  Refunds are not given on free hair for obvious reasons.,  Once the hair has been removed from the package, installed or altered in any way, no refunds will be accepted.   Refunds will be given on bundles still in the original package, with hair tags still attached, and weft unbound, within 48 hours of purchase.  Beyond that, refunds will not be given.   Thank you for understanding and keeping the community safe.
